Contest Rules

To enter, the WIN A GETAWAY TO ST. JACOBS COUNTRY Contest (the "Contest") complete the official entry form via the Internet at www.stjacobs.com. Entries will only be accepted online. Only one entry per email address allowed during the entire promotional period. In the event it is discovered that a contestant attempted to enter more than once, all of that contestant's entries will be void. All entries must be received by 11:59:59 p.m. EST December 31, 2010 (the "Contest Closing Date"). All eligible entries received by the Contest Closing Date will be included for the draw. Mercedes Corp. (the "Contest Sponsor") will not be responsible for late, lost, misdirected, incomplete or destroyed entries.
The Prize
There will be one (1) Prize available to be won. Travel to and from St. Jacobs, Ontario, accommodations, optional excursions, medical, travel and baggage insurance together with any required travel documentation, local and long distance telephone calls, incidentals, transportation, taxes and other personal expenses are the sole responsibility of the Prize winner. Odds of winning depend on the number of eligible entries received. For US residents any income tax payable on the Prize is the sole responsibility of the winner.
The Draw
A random draw will be held January 2011 in St. Jacobs, Ontario from all eligible entries received to award the Prize. The Prize selected entrant will be contacted by email, telephone, mail or courier within 14 days of the draw. Contest Sponsor is not responsible for change of email, mailing address or telephone number of the Prize selected entrant. In order to win, the selected entrant must correctly answer a mathematical skill-testing question without mechanical aid and any selected entrant must be eligible according to the official rules. In the event a selected entrant cannot be contacted within 14 days of Prize notification, or if any prize notification is returned as undeliverable, or the selected entrant is disqualified, the prize will be forfeited and another entrant will be chosen. The winner (who must both be age of majority in their province or state of residence) will be required to sign a standard Declaration and Liability Release form to release and hold harmless the Contest Sponsor, its directors, employees, officers and agents, including without limitation its advertising and promotion agencies from any injury, loss or damage of any kind to persons, including death or property. damage resulting in whole or in part directly or indirectly from acceptance, receipt, possession, use or misuse of Prize, participation in any Contest-related activity or participation in Contest including any travel related thereto.
Eligibility
The Contest is open to all legal residents of Canada (excluding Quebec) who have reached the age of majority in their province of residence and is open to all legal residents of the continental United States (excluding Florida), who have reached the age of majority in their state of residence at the contest start date. Contest excludes employees (and persons with whom they are domiciled) of the Contest Sponsor, its advertising and promotional agencies, tenants and marketing partners. This Contest is subject to all applicable Federal, Provincial, Municipal and State laws and regulations. All decisions of the independent contest judging organization are final and the Contest Sponsor and the independent contest judging organization shall not be held responsible for any accident, negligence, printing, administrative or other errors that may arise or occur in connection with the Contest. The Contest Sponsor reserves the right to modify, amend or terminate this Contest with no obligation or liability if due to fraud, virus, bugs or other causes beyond the control of the Contest Sponsor corrupt the administration, security or proper play of the game, subject to applicable law. By entering this contest, the entrant agrees that the courts of the Province of Ontario, Canada shall have jurisdiction to entertain any action or other legal proceedings based on any provision of these rules or the running of this Contest. The entrant hereby irrevocably attorns to the exclusive jurisdiction of the courts of the Province of Ontario. By participating in this Contest, each entrant and his/her travel companion agrees to fully indemnify the Contest Sponsor and its directors, officers, employees, and agents from any and all claims by third parties without limitation.
The Prize must be accepted as awarded, is non-refundable, non-transferable and is not convertible to cash. The Contest Sponsor reserves the right to substitute a prize or any portion thereof with a one of equal or greater value. No correspondence will be entered into except with the selected entrant. By entering this Contest, the entrants consent to the use of their names, cities of residence, video images, and/or photographs in any related publicity or Internet posting without compensation, except where prohibited.
All entries become the property of the Contest Sponsor upon receipt and will not be returned. No responsibility will be taken for any failure of the web site during the promotion or for any problems or technical malfunction of a telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any e-mail, on-line Internet or telephone entry to be received by the Contest Sponsor due to technical problems or traffic congestion on the Internet or at any web site, or any combination thereof including any injury or damage to an entrant's or any other person's computer related to or resulting from playing or downloading any material in the promotion. The Contest Sponsor reserves the right, in its sole discretion to cancel or suspend this Contest should a virus, bug or any other cause beyond the reasonable control of the Contest Sponsor corrupt the security or proper administration of the Contest. Any attempt to deliberately damage any web site or to undermine the legitimate operation of this promotion is a violation of criminal and civil laws, and should such an attempt be made, the Contest Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law - including criminal prosecution. Entries are subject to verification and will be declared invalid if they are altered or tampered with in any way. Entries that are inaudible or unintelligible will be disqualified. The Contest Sponsor assumes no responsibility for human or technical error in the transmission or receipt of phone entries. The winner releases the Contest Sponsor, its directors, employees, officers and agents, including without limitation its advertising and promotion agencies, from any and all liability, loss or damage incurred with respect to the awarding, receipt, possession, and/or use or misuse of any prize, including any travel related thereto. The Contest Sponsor reserves the right, in its sole discretion, to terminate the Contest or to amend or modify the official rules at any time without prior notice, for any reason whatsoever.
In the event of a dispute regarding the identity of the person submitting an electronic or telephone entry, the entry will be deemed to be submitted by the "authorized account holder" in whose name the email account / telephone is registered, provided that person meets all eligibility criteria set forth in the Eligibility section of these Official Rules. "Authorized Holder" shall mean the natural person assigned to an email address / telephone number, by an Internet Access provider, on-line service provider, telephone service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address / or for assigning numbers for the telephone account associated with the submitted telephone number. The Contest Sponsor reserves the right at its sole discretion, to disqualify any individual (and all of his or her Contest entries) who tampers with the entry process.
